Copyright and intellectual property policy

How to tell us when something on Momint uses your work without permission.

The short version

  • What you post on Momint is yours. What other people post is theirs.
  • Only post photos, videos and other content you made yourself or have permission to share.
  • If something on Momint infringes your copyright or other rights, tell us. We'll look at it and, where it infringes, take it down.
  • Repeatedly posting other people's work without permission can get your account suspended or closed.

Who runs Momint

Momint is run by MOMINT LTD, a company registered in England and Wales (company number 17391050), registered office: 2nd Floor Excel House, 84 Edgware Way, Edgware, England, HA8 8JS.

What this policy covers

Copyright (photos, videos, music in videos, text, artwork) and other intellectual property rights, such as trade marks. If your concern is about privacy rather than ownership (for example, a photo of you posted without your agreement), use our reporting process instead; you don't need to own the photo to ask us to look at it.

How to report an infringement

Email copyright@momintapp.com with the subject line "Copyright report" and include:

  1. Who you are: your name and contact details (email, and postal address if you're comfortable sharing it). If you're acting for the rights holder, say who they are and your authority to act.
  2. The work: describe the work you say is being infringed (a link to the original is ideal).
  3. Where it is on Momint: the share link (for example https://momintapp.com/p/...), the username of the account, and any other detail that helps us find it, such as a screenshot. Hangouts, chats and memories are often private, so the more detail the better.
  4. Why it infringes: a short explanation.
  5. A statement that you believe in good faith that the use isn't authorised by the rights holder, their agent or the law.
  6. A statement that the information in your report is accurate and that you are the rights holder or authorised to act for them.
  7. Your signature (typing your full name is fine).

You can report a specific post, comment, memory, photo, video, hangout or message from inside the app, as well as by email. For copyright claims the email route above is still the one to use, because a copyright notice needs the declarations listed below.

What happens next

  • We'll acknowledge your report within 2 working days.
  • We review it. If it's incomplete, we'll ask you for what's missing.
  • If we're satisfied the content infringes, we'll remove it or disable access to it promptly.
  • We'll tell the person who posted it what we removed and why, and how they can respond.
  • We won't pass your name or contact details to the person who posted the content unless you ask us to. If you want to resolve it with them directly, tell us and we'll ask their permission first. This is different from other reports on Momint, where we never identify the reporter at all: a copyright claim is a legal assertion, and if it goes further you may need to be named. We'll tell you before that happens.

We may decline reports that are incomplete, clearly unfounded, or aimed at silencing lawful content (for example criticism, commentary or parody that is a fair dealing under UK law).

If your content was removed and you think we got it wrong

Reply to the email we sent you, or email the address above with the subject "Copyright counter-notice", explaining:

  • which content was removed,
  • why you believe it doesn't infringe (for example, you created it, you have a licence, or the use is permitted by law),
  • your name and contact details, and a statement that the information is accurate.

A person at Momint will review it. If we agree, we'll restore the content. We may share your response with the person who reported it. See also how complaints and appeals work.

Repeat infringers

We may suspend or permanently close accounts that repeatedly post content that infringes other people's rights. As a guide, three upheld reports within 12 months will normally lead to closure, and a single serious or deliberate case can lead to closure on its own. We'll tell you what we've decided and how to appeal.

Shared hangout photos

In a hangout's shared memory, the person who uploaded a photo stays its owner. Other attendees can see it and may post it to their own Momint profile, but they don't become its owner. If the uploader deletes the photo, it disappears from every post it appears in. Photos are only as "yours" as your rights in them: uploading someone else's work to a hangout memory doesn't make it okay.

False or abusive reports

Please only report content you genuinely believe infringes your rights. Knowingly false reports may be ignored, can lead to action on your account, and could expose you to legal liability.
