The short version
- These terms are the rules for using Momint. By creating an account, you agree to them.
- You need to be at least 16.
- Your photos, videos and posts stay yours. You give us permission to store and show them so Momint works.
- Follow our Community Guidelines. If you don't, we may remove content or suspend or close your account, and we'll tell you why.
- Momint+ is sold through the App Store and Google Play. Cancel it there.
- Nothing in these terms takes away your legal rights as a consumer.
1. About these terms
1.1 Who we are
Momint is provided by MOMINT LTD, a company registered in England and Wales, company number 17391050, registered office 2nd Floor Excel House, 84 Edgware Way, Edgware, England, HA8 8JS. Email: hello@momintapp.com.
"Momint", "we", "us" and "our" mean MOMINT LTD. "You" means the person using Momint.
1.2 What these terms cover
These terms apply when you use the Momint app, our share-link pages, and anything else we provide under the Momint name (together, "Momint").
They include:
- our Community Guidelines,
- our Copyright policy,
- how we handle reports, complaints and appeals.
Our Privacy Policy explains how we handle your personal data. It isn't part of this contract, but please read it.
1.3 Agreeing to these terms
You agree to these terms when you create a Momint account. If you don't agree, please don't use Momint.
We record against your account which version of these Terms you accepted, and which version of the Privacy Policy you were shown, with the date and time. The app reads the current versions from the server at sign-up, and the Privacy Policy is linked before you enter your email address. If either changes in an important way, we show you the new version, and we ask you to accept new Terms before you carry on using Momint.
2. Who can use Momint
- You must be at least 16 years old. This is the same in every country where Momint is available.
- If you're under 18, please make sure a parent or guardian is happy for you to use Momint and has read these terms with you. Some parts of Momint aren't available to you: you can't see, join or host public hangouts, and advertising is never personalised to you.
- You can't use Momint if we've previously banned you, or if the law where you live doesn't allow it.
- One personal account per person. Momint is for personal use, not for businesses or commercial promotion.
3. Your account
- Be accurate. Give us your real date of birth and an email address you control. You can't change your date of birth in the app, so get it right.
- Usernames must be 3 to 24 characters (letters, numbers, dots and underscores). Don't pick a username that impersonates someone, infringes a trade mark, or is offensive. We may reclaim usernames that break these rules.
- Keep your email secure. Momint has no passwords. We email you a one-time code each time you sign in, so anyone who controls your email can get into your account. We will never ask you for your sign-in code. Never share it.
- Your devices. You can see where you're signed in, and sign devices out, in Settings > Devices & sessions.
- Tell us straight away at hello@momintapp.com if you think someone else has got into your account.
- You're responsible for what happens on your account, unless someone got in because of something we did wrong.
4. Using the Momint app
- We give you a personal, non-exclusive, non-transferable licence to download and use the Momint app on devices you own or control, for as long as you have an account and follow these terms.
- If you got the app from the Apple App Store, section 20 also applies.
- Some features need permissions on your phone (camera, microphone, photos, location, notifications). You can say no; some features just won't work.
5. Your content
"Your content" means anything you add to Momint: photos, videos, captions, comments, memories, hangouts, chat messages, polls, your profile, and so on.
5.1 You own it
You keep ownership of your content. We don't claim it.
5.2 Permission you give us
To run Momint, we need your permission to do certain things with your content. So you give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, process, adapt (for example, resizing, compressing or reformatting photos and videos, or adding a Momint watermark to downloads), display and distribute your content, but only to:
- provide, run, secure and improve Momint,
- show your content to the people you've chosen, in line with your settings,
- show previews when you, or someone allowed to, share a link to it,
- comply with the law and enforce these terms.
This licence ends when you delete the content or your account, except that:
- copies other people have already saved or downloaded are outside our control,
- deleted content may remain in our backups for a limited time, until that backup is replaced in the normal cycle,
- we may keep content where the law requires it, or where we need it for a legal claim or to keep people safe.
5.3 Permission you give other Momint users
When you share content with other people on Momint, you allow them to view it within Momint in line with your settings. In addition:
- Hangout memories. When you add photos or videos to a hangout's shared memory, everyone going to that hangout can view and download them and can post them on their own Momint profile. The content stays yours. If you delete it, it disappears from any post it appears in, including other people's. If you remove yourself from a hangout's shared memory, or the host or a co-host removes you from the hangout, the photos and videos you added there are deleted.
- Shared memories. When you share a memory, you choose whether the people you share it with can share it further or post it to their feed.
- Share links. Anyone who has the link to a public post, or to an active hangout, can see a preview of it, even without a Momint account. A link to one of your memories shows your username and profile photo, and a photo from it only if you've posted that photo publicly. The Privacy Policy explains exactly what each link shows.
- Hangout invite links. Anyone who has a hangout's invite link can join that hangout (except people under 18, for a public hangout). Share it with care. The host can replace the link at any time.
5.4 What you promise about your content
By posting content, you promise that:
- you created it, or you have all the rights and permissions needed to post it and grant the licences above,
- the people who appear in it are okay with it being shared (for photos of children, their parent or guardian is okay with it),
- it follows these terms, our Community Guidelines, and the law.
5.5 Public means public
If you make something public, anyone on Momint can see it, and people can take screenshots. Think before you post.
5.6 Deleting your content
You can delete your posts, photos, videos, memories and comments at any time.
- Deleting a post takes the post down, along with its comments and likes. The photos and videos in it stay in your memories.
- Deleting a photo or video removes it from every post that uses it, including posts other people made using it.
5.7 We don't check everything in advance
We don't review content before it's posted, and we're not responsible for content other users post. But we do act on reports and on content we become aware of (see sections 7 and 8).
6. Rules for using Momint
You must follow our Community Guidelines. In particular, you must not:
- break the law, or help anyone else break it,
- harass, threaten, bully or abuse anyone,
- post nudity or sexual content,
- post sexual content involving anyone under 18, or any content that sexualises children,
- share intimate images of anyone without their consent,
- post content that encourages suicide, self-harm or eating disorders,
- impersonate anyone, or mislead people about who you are,
- spam people, or use bots, scripts or other automated ways to access Momint, create accounts, or collect other people's data ("scraping"),
- try to get around our limits, blocks, suspensions or security, or access accounts or data you're not allowed to,
- probe, scan or test our systems for weaknesses without our written permission,
- interfere with Momint working normally (for example, by overloading it),
- copy, modify or reverse-engineer the app, except where the law allows,
- sell, rent or transfer your account.
7. How we keep Momint safe from illegal and harmful content
- Our rules ban illegal content and content that's harmful, especially to young people (see the Community Guidelines).
- Reporting: anyone can report content or accounts, in the app or by email (see how reporting works).
- Review: reports are reviewed by people at Momint. We deal with the most serious reports first.
- Action: if content breaks our rules or the law, we remove it or stop it being shown, and we may restrict, suspend or close the account involved.
- Authorities: we report child sexual exploitation and abuse to the UK's National Crime Agency, and we may contact the police where someone's life or safety is at risk.
- Automated tools: we don't currently use automated tools to scan or detect content. Momint does automatically limit accounts that behave like spam for up to 24 hours: while the limit lasts, the account can't send friend requests or join or create hangouts, and its profile, posts and hangouts are hidden from other people. Accounts that upload an unusually large amount in a short time are automatically flagged for a person at Momint to review; nothing is removed because of that flag alone.
8. Moderation, suspension and your right to appeal
8.1 What we can do
If you break these terms or the Community Guidelines, or if we need to in order to comply with the law or protect people, we may:
- remove or restrict your content,
- limit some features for a while,
- warn you,
- suspend your account temporarily,
- close your account permanently.
We decide based on how serious it is, whether it was deliberate, and your history on Momint.
8.2 We'll tell you why
When we take action, we'll tell you what we did, which rule or law it relates to, whether any automated tools were involved, and how to appeal, unless telling you would put someone at risk or break the law.
8.3 Appeals
If you think we got it wrong, you can ask us to look again (see appeals). Where more than one person was available to decide, your appeal is reviewed by someone who wasn't involved in the original decision. If we got it wrong, we'll put things right.
8.4 Serious or repeated breaches
For the most serious breaches (such as child sexual exploitation, credible threats of violence, or sharing intimate images without consent), or repeated breaches, we may close your account immediately and without warning, and stop you from creating new accounts.
9. Blocking and reporting
You can block or mute other users, and report content or accounts, at any time. See Reporting content and making complaints.
10. Hangouts happen in real life
Momint helps people organise meetups. We don't organise, supervise, check or attend hangouts, and we don't check who people are.
- Hosts are responsible for the hangouts they create: for describing them honestly, and for not organising anything illegal or unsafe. Anyone with a hangout's invite link can join it, so think about where you share it.
- Everyone is responsible for their own safety when meeting people. Meet in public places and tell someone where you're going.
- Public hangouts are 18+. If you're under 18 you can't see, join or host one.
We're not responsible for what other people do at a hangout. This doesn't limit our responsibility where the law says we can't limit it, for example if our own negligence causes death or personal injury (see section 16).
11. Momint+
Momint+ is an optional paid subscription that unlocks the following:
- no advertising anywhere in the app,
- 15 photos or videos per post, instead of 10,
- 200 files per hangout memory, instead of 100,
- video uploads up to 100 MB, instead of 50 MB,
- sharper photos: photos are uploaded, stored and downloaded at up to 3840 pixels on the long edge, instead of 1920,
- downloads without the Momint watermark by default (without Momint+, you can still remove it one photo at a time),
- bulk downloads: save a whole selection of photos at once.
How it works:
- Buying: Momint+ is sold through the Apple App Store or Google Play. The price and billing period are shown to you before you buy, in pounds sterling. Payment is taken by Apple or Google, under their terms. There is no free trial.
- Renewal: your subscription renews automatically at the end of each period unless you cancel at least 24 hours before it ends.
- Cancelling: cancel in your App Store or Google Play subscription settings. Deleting your Momint account doesn't cancel your subscription, so cancel it in the store too.
- Gifts: we may give you Momint+ as a gift, through a link we send you. A gift is issued by Momint, not bought from Apple or Google: nothing is charged, it doesn't renew, and it simply ends on the date we tell you. If you already have Momint+, a gift is added on top of what you have — it never shortens it. You have to open the link and choose to accept it; nothing happens just because a link exists.
- Refunds and cancellation rights: refunds are handled by Apple or Google under their policies. Your legal rights, including any right to cancel within 14 days under UK consumer law, are not affected. Because Momint+ is digital content supplied immediately, the 14-day cancellation right under the Consumer Contracts Regulations normally ends once we start providing it with your agreement; the store's own refund policy is usually the quicker route.
- Changes: if we change the price, we'll tell you in advance, and you can cancel before the new price applies. If we remove a significant Momint+ feature, we'll tell you, and you can cancel.
12. Momint's own rights
The Momint name, logo, app, design and software belong to us or our licensors. These terms don't give you any rights to them, except the right to use the app described in section 4.
If you send us ideas or feedback, we may use them without owing you anything.
13. Other services
Momint may link to services run by other companies, for example your phone's maps app (such as Apple Maps or Google Maps) for directions. Those services have their own terms and privacy policies, and we're not responsible for them. Apple and Google also have their own terms for app downloads, notifications and purchases.
14. Ending your account
14.1 If you want to leave
You can delete your account at any time in Settings > Details > Delete your account. If you can't use the app, email privacy@momintapp.com from your account's email address with the subject line "Delete my account".
- Your account is hidden immediately.
- You have 14 days to change your mind by signing back in.
- After 14 days, your account and personal data are permanently deleted. Hangouts you host are deleted for everyone at that point, along with their chats; photos other people added to a hangout's shared memory stay with them. See the Privacy Policy for what may remain (for example, copies other people downloaded, or data we must keep under a legal hold).
14.2 If we end or suspend your account
We may suspend or close your account if:
- you seriously or repeatedly break these terms or the Community Guidelines,
- we have to, to comply with the law or a regulator or court,
- your account creates a risk of harm or legal exposure for other people or for us.
We'll usually give you notice and the reasons first, unless there's an urgent reason not to (for example, a safety risk or a legal requirement). You can appeal (section 8.3).
If we close your account without a good reason under these terms while you have an active Momint+ subscription, we'll help you get a refund for the part of the period you couldn't use, by supporting your refund request to Apple or Google.
14.3 What survives
Sections that by their nature should continue after your account ends (such as 5.2 for backups and legal holds, 12, 16 and 17) continue to apply.
15. Changes
15.1 Changes to Momint
Momint is still growing. We may add, change or remove features. If a change significantly affects how you use Momint, we'll tell you in advance, unless we have to make it urgently (for example, for security or legal reasons).
15.2 Changes to these terms
We may update these terms, for example to reflect new features, changes in the law, or to make them clearer. If a change is important, we'll tell you at least 30 days before it takes effect, in the app or by email. If you don't agree, you can stop using Momint and delete your account before the change takes effect.
16. Our responsibility to you
If you're using Momint as a consumer:
- We're responsible for loss or damage you suffer that is a foreseeable result of us breaking these terms, or of us failing to use reasonable care and skill. Loss is foreseeable if it was obvious it would happen, or if both of us knew it might happen when you started using Momint.
- We're not responsible for loss that isn't foreseeable.
- Momint is for personal use. We're not responsible for any loss of business, profit or opportunity.
- Damage to your device or other digital content: if something we supply damages a device or digital content that belongs to you, and that happened because we didn't use reasonable care and skill, we'll either repair the damage or pay you compensation.
- Content from other people: we're not responsible for content that other users post or send, except where the law makes us responsible.
- Keep your own copies. We work hard to keep Momint running and your content safe, but we can't promise the service will always be available or free of errors. Please keep your own copies of photos and videos that matter to you.
Nothing in these terms limits or excludes our liability for:
- death or personal injury caused by our negligence,
- fraud or fraudulent misrepresentation,
- anything else that can't be limited or excluded by law, including your rights under the Consumer Rights Act 2015.
For more on your legal rights, contact Citizens Advice (in England and Wales) or Advice Direct Scotland.
17. Disputes and the law that applies
- If you have a problem, please contact us first at hello@momintapp.com. Most things can be sorted out quickly.
- These terms are governed by the law of England and Wales.
- You can bring legal proceedings in the courts of England and Wales. If you live in Scotland, you can also bring proceedings in Scotland. If you live in Northern Ireland, you can also bring proceedings in Northern Ireland.
- If you live in the EU or EEA, you also benefit from the mandatory consumer protections of the country where you live, and you can bring proceedings in your local courts.
- If you live elsewhere, you may have rights under your local law that these terms can't take away.
18. General
- Transferring this agreement: we may transfer our rights and obligations under these terms to another organisation (for example, if Momint is sold). We'll tell you, and it won't reduce your rights. You can't transfer your account or these terms to anyone else.
- If a court finds part of these terms unlawful, the rest still applies.
- If we don't enforce something straight away, we can still enforce it later.
- Third-party rights: no one else has any rights under these terms, except Apple as described in section 20.
